HTML Web Design, it's owners employees and contractors undertake to design and build a website as per the instructions given by you, the client. It is understood that you, the client will supply whatever graphics, text and other components required to carry out same, unless otherwise specified in writing. This will be arranged and agreed to prior to our agreeing to undertake to build your website. With regard to COPYRIGHT. All website content, whether text, image, photograph or any other copyrightable material is the sole responsibility of the client, i.e. the OWNER of the website (the registered owner of the Domain Name under which the website will reside on the Internet). HTML Web Design will take all reasonable action to ensure that your website is built on time (as per estimates that may be given from time to time) however, the nature of Web Design and Construction cause it to be given to sometimes uncontrollable delays. This, coupled with our reliance upon our clients and third parties to supply information and materials necessary to complete or effect certain works or functions, we cannot be held responsible for delays, which may result in the late delivery of your website. Accordingly, you, the client, agree to indemnify HTML Web Design against any and all costs and consequences, which may result from any such delays. Given the nature of Search Engine algorithms and the internet in general, plus the fact that Search Engine Rankings are dependent on ongoing maintenance, link building and content updates etc, on the part of the client, NO company can guarantee website performance or rankings, in any way. HTML Web Design undertake to effect all possible techniques and methods, based on our experience, to ensure the best possible result within the Search Engine Results pages, short of practices which are against Search Engine policies or instructions, but it cannot be guaranteed that any specific result or ranking within the Search Engine Rankings Pages will occur. Further, you, the client, agree to limit any claim whatsoever, for whatever reason or purpose, to the amount quoted by HTML Web Design to undertake and complete the design and construction of your website. This is in keeping with our guarantee to refund the full cost of the website, should the client not be satisfied. Should this situation arise and such refund be given, the website will remain the property of HTML Web Design and will NOT be available, in part or in full, for use by the client under any circumstances. I understand that access to the website, webmail and email accounts and any other components, which are part of or an extension of the website, is facilitated by the WEB HOSTS and HTML Web Design has no control over and cannot be responsible for such access or lack thereof at any time. I am aware that queries or enquiries regarding any problems arising, which concern access to the website or it's components (including email accounts attached thereto) by myself or any Internet user should be directed to the Web Host who facilitates such access. I signify my acceptance of these terms and conditions by indicating 'Yes' in the drop-down menu below and submitting this information to HTML Web Design.
